Changes in street trade in the territory of Rezekne municipality
Street trade in public places such as streets, parks, areas which are accessible to any natural person shall be regulated by Cabinet Regulation No. 440 “Regulations regarding the types of trade to be co-ordinated with the local government and the procedures for organising trade” and binding regulations issued by local governments.
The binding regulations No. 49 of the Rēzekne District Council on trade in public places in Rezekne District, which entered into force with effect from 1 January 2023, shall be determined in the territory of Rezekne District.
The most important provision for street trade is the receipt of a marketing authorisation from the municipality. The authorisation shall be necessary for the day-to-day trade in any place authorised for sale in the territory of the municipality, which shall be determined by the head of the administration. The authorisation shall also be necessary for the performance of trade during public events, including the “VILNIUS MARKET” organised by the local government and trade from mobile retail points.
Authorisations issued until 30 December 2022 shall be valid until 31 March 2023. After that period, all street trading participants must have received a new authorisation, which must be presented to the employees of the local government and the national control authorities. If such permits are not and planned to participate in street trade, it is necessary to design it now.
In order to obtain an authorisation, a submission form shall be completed, in which the term of the permit is indicated and a certificate regarding non-performance of economic activity must be attached to a natural person, but a registration certificate shall be issued to a legal person, if the existence of a cash register or receipts has been issued and certified, if it is specified in the laws and regulations after the goods marketed. In addition, a co-ordination with the owner shall be submitted if the place of sale is not in the ownership or possession of a local government.
Documents for the receipt of a permit may be www.latvija.lv electronically by persons, if there is a possibility to sign by electronic signature – a trade administrator to e-mail: in tirgus@rezeknesnovads.lv or on-site, by post in the offices of the municipality, parish or transferred to the trade administrator who performs the examination of documents and the issuance of the permit.
These Regulations prescribe that the submission must be submitted at least 10 working days prior to the performance of the trade, but the period of preparation of the permit from the day of submission of documents correctly drawn up - 5 working days.
Submission forms are available, attestation to a natural person and an overview of documents to be submitted in local government websites, local government administration and administrations.
The permit shall be issued in electronic format, but may also be obtained in a printed local government administration, administration or event.
It should be noted that the authorisation is issued after payment of the trade fee for the period indicated in the application and also fixed in the permit.
If the permit is issued electronically, the administrator shall send the payment information to the e-mail indicated in the submission. After payment, when a person sends a payment order to an administrator, a permit is sent and trade may be started.
If a person wishes, the payment of the fee shall also be paid to the administrator of the local government at the administrator prior to receipt of the permit, if it is issued electronically or until the receipt of the permit, if the permit in printed format.
The local government has determined the amount of the fees for one trading venue, which is 3 metres, and for each next metre:
EUR 30,00 per year for mobile trade points of food and industry.
daily trade: EUR 5,00 per day for catering service; EUR 20,00 per month; EUR 30,00 per year.
• produced in excess OF EUR 2,00 per day; EUR 10,00 per month; EUR 30,00 per year.
for used goods, self-produced and obtained products EUR 1,00 per day; EUR 5,00 per month; EUR 25,00 per year.
The administrative, urban-significance measures, including “VILNIUS MARKET”, have set fees: the catering service and alcohol AT EUR 10.00 per day and EUR 5.00 per day for other goods.
On the other hand, parish measures: EUR 5.00 per day, alcohol EUR 10.00 per day, EUR 3.00 per day for other goods.
The Rēzekne municipality in the final-central events was transferred to the catering service, alcohol EUR 25,00 per day, and for other goods – EUR 10.00 per day.
In order to be able to schedule events, the organiser may publish information on the modalities of the application, or the harmonisation of membership, the place of sale, the identification of the groups of goods whose trade will be permitted in the event, the order of arrival and other requirements.
In this respect, a trading administrator, who is also an organiser for monthly street trade IN Viļānos “VILNIUS MARKET”, informs that the event will be held at the same time on the second Sunday of each month. 7.00-14.00, but for traders, the time of arrival and the place of admission is November – February to 12.00 7.00, March – October – October 6.00. At the moment, the pre-allocated trading venues are retained during the winter period, but the location of the product groups is changed from April, while preserving places for trade – the city stadium, Rainis, flowers, central and Rēzekne Street, where the new or approved old trading venue (place number) will be granted with the new permit.
Traders, when applying for participation in events and receiving a marketing authorisation, shall undertake to comply with the procedures laid down by the organiser.
