Rezekne District Municipalities Data privacy policy

 The administration of the municipality of Rezekne, its departments and local government institutions shall implement the fulfilment of the functions and tasks delegated to the local government, which often also determine the necessity to process personal data. The local government shall comply with the requirements laid down in the General Data Protection Regulation, the Personal Data Processing Law and other regulatory enactments regarding the legality and protection of the processing of personal data.

The purpose of the data privacy policy is to provide information on the main purpose of the processing of personal data by us, their legal basis and other information in accordance with Regulation No 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) for the purposes of Article 13:

Basic purpose of processing personal data:

  • Population accounting (including the processing of declared residence data);
  • Accounting of civil status documents (including records of birth, death and marriages);
  • Accounting of real estate tax payers;
  • Accounting of the work of the construction board;
  • The accounting of social assistance;
  • Accounting of recipients of social care and social rehabilitation services;
  • Accounting of Orphan's Court cases (including notarial services);
  • Accounting of administrative irregularities;
  • Accounting of educational establishments;
  • Accounting of records of records (including the processing of personal data necessary for the accounting of other functions imposed by the local government);
  • Accounting records;
  • Registration of personal files;
  • Registration of applicants;
  • List of visitors to the library;
  • Video surveillance (prevention and detection of criminal offences related to the protection of the security and property of natural persons);
  • Customer accounting for the provision of management and maintenance services;
  • Accounting of clients (patients) for the provision of health care services.
  • Inventory of museums (intangible cultural heritage)

Legal basis for processing personal data:

The legality of the processing of personal data by us shall be determined by at least one of the following grounds:

  • The data subject (natural person) has given consent to the processing of his personal data for one or more specific purposes.
  • Processing is necessary for the execution of a contract which is a party to the data subject, or for the performance of measures at the request of the data subject prior to the conclusion of the contract;
  • Processing is necessary in order to comply with the obligations laid down in the laws and regulations of the Republic of Latvia in force in the Republic of Latvia;
  • Processing is necessary to protect the vital interests of the data subject or other natural person;
  • Processing is necessary for the execution of a task carried out in the public interest or in the exercise of official powers conferred on the controller;
  • Processing is necessary to respect the legitimate interests of a controller or a third party, except where the interests of the data subject or fundamental rights and fundamental freedoms requiring the protection of personal data are more important than such interests, in particular when the data subject is a child.

Additional sources of personal data: Information provided by the data subject. Personal data are also derived from national information systems for individual purposes.

Duration of personal data retention: the duration of the storage depends on the purpose of the processing of the personal data concerned, without exceeding the time limit laid down in the laws of the Republic of Latvia.

Recipients of personal data: The data subject (natural person) for himself; the staff authorised by the municipality of Rezekne; the processor providing the service to the local government in accordance with the mutually agreed contract; the national controlling bodies (if they have an appropriate mandate). Personal data are not sent to third countries or international organisations.

The rights of the data subject: Your rights are determined and regulated by the General Data Protection Regulation, including but not limited to:

  • Right to be informed - You have the right to be informed, in a transparent and comprehensible manner, with information on the processing of personal data.
  • Right of access to personal data - You have the right to request information from the local government regarding the processing of personal data you have performed.
  • Right to Repair Personal Data - if you believe that information about you is incorrect or incomplete, you have the right to ask the local government to correct them. In view of your request, the local government will ensure that your personal data are corrected if they are inappropriate, incomplete and/or inaccurate. If the local government decides not to correct your personal data, the local government will provide you with an explanation why they will not be corrected.
  • Right to withdraw consent for processing of personal data - cin so far as the local government processes your personal data on the basis of your consent, you have the right to withdraw your consent to the processing of personal data at any time. In this case, the local government will stop processing your personal data for the purpose for which you gave your consent. 
  • The right to request the deletion of personal data - In certain circumstances, you have the right to ask the local government to delete your personal data (for example, if your personal data processing is based solely on your consent). In turn, if the processing of your personal data is regulated and determined by external laws, the local government will not be able to delete your personal data.
  • The right to restrict or object to the processing of data - In certain circumstances, you have the right to require the local government to temporarily restrict the processing of your personal data (for example, in cases where the data subject has detected inaccuracies in his personal data and the local government needs time to verify the accuracy of the data, or the data subject may oppose the use of personal data in profiling, for direct marketing purposes, or for scientific or historical research purposes or for statistical purposes, except where the processing is necessary to carry out the task carried out in the public interest). For information, if you require your data processing to be restricted, or you oppose data processing, it may affect your ability to receive municipal services. 
  • The right to portability of personal data - You have the right to receive or transfer your personal data to another third party. If a local government processes personal data in accordance with the consent of the data subject or on the basis of a contract and is stored in a structured, widely used and machine-readable format, the data subject shall have the right to request the transfer of personal data directly from one controller to another controller if technically possible. These rights shall not apply to personal data which are processed in order to comply with a legal obligation attributable to a local government or, in order to fulfil a task carried out in the public interest or in the exercise of official powers lawfully conferred on the local government.
  • The right not to be a subject of an automated individual decision, including profiling, Each data subject shall have the right not to be subject to a decision which is based solely on automated processing (without human involvement), including profiling which creates legal consequences for the data subject or has a significant effect on it in a similar manner. We are informed that the municipality does not make automated decision-making for the processing of personal data.
  • Right to complain - If you are not satisfied with the local government's reply, do you consider that the local government is carrying out the processing of personal data contrary to the requirements of the laws and regulations, you may submit a complaint to the supervisory authority - a data protection officer or a data protection specialist designated by the local government.

Decision-making: The processing of personal data does not involve automated decision-making, including profiling.

Additional sources of personal data: The “register of citizens” in the management of the Ministry of Citizenship and Migration Affairs, the Integrated Information System of the Ministry of the Interior and the Register of Sanctions, THE NATIONAL System (Information System for the Support of Minors), the Unified Migration Information System (VMIS), the foster family information system (AGIS) and the State Land Register, and the information system of the register of natural persons in the application “FPRIS”.

Duration of personal data retention: According to the shelf-life specified in the Orphan's court case list (individual documents are not deleted).
