On tariffs for the management of multi-apartment buildings IN parish Lūznavas
The municipality of Rēzekne Municipality has received Lūznavas parish residents and complaints regarding a multi-apartment building operator – Maltas apartment utility company (DzKSU) – a decision to increase the management fee by 1 January 2016.
Since Maltas DzKSU is not a substructure of the municipality of Rezekne, but a municipal capital company, which has delegated the function of the municipality to the management OF multi-apartment buildings IN Maltā and Lucznava, the municipality of Rēzekne is not eligible to intervene in the activities of the company, for example in dealing with management-related issues, unless there is a visible illegal activity. Residential house management issues have to be addressed by the apartment owners themselves and the company as a house manager, in accordance with the norms of the Law on Management of Housing Houses and the Housing Property Law. Maltas JCC activities shall be supervised by the local government institution – 1 TP44T parish administration and in accordance with regulatory enactments and the decisions of the council, the head of such institution shall take decisions regarding the member of the board of directors of the undertaking, as well as supervise the activities of the undertaking.
Currently, the municipal management has given a task to the representative of the shareholder, Maltas parish management manager Vitaly Skudar, to clarify the situation OF Maltas DzKSU and to provide explanations on the activities carried out: both the methods of survey of the population and the need for additional vacancies, both that form the management tariff and whether the planned unit of the lawyer will be paid exclusively from the management fee or the other tariffs, such as water supplies and heating. IT is expected that Maltas DzKSU will be submitted to the local government at the beginning of the next week. These explanations will be published on the website of the municipality of Rezekne so that they can also be acquainted with apartment owners Maltas and Lūznavas parish.
It must be said that in all house management companies, both SIA “Rezekne Builder” and SIA “Premier of Preiles” and others, there are one or more lawyers who work with both debtors and other issues. Also, Maltas DzKSU had been required for a long time by both a lawyer and a qualified home management specialist with appropriate education, as it is impossible to carry out these duties fully with existing resources. It should be noted that the pay of a lawyer does not need to be treated as an additional burden solely on account of debtors, which are administrative resources, similar to that of the company's board of directors, the accountant, the cashier or the tractor driver, which is necessary to ensure the company's ability to work. As regards the rejoinder, when there are already lawyers in the municipality, it is explained that the existing lawyers are fully busy dealing with the issues of the council and there is no possibility of another of these employees in the municipal company. And as mentioned above, Maltas DzKSU is a company that operates on the basis of the Statutes, has its own balance sheet, accounting, property and financial resources, the municipality is not responsible for the company's liabilities, but the company is not responsible for municipal liabilities. The municipality does not finance the company and therefore all expenses, including the costs of maintenance of employees, must be borne by the company itself from the fees charged for the services. We assume that there has been insufficient explanation from the company that we will be averting in the near future.
In order to explain the need for improvement of management fees, to inform regarding the work performed and planned works, as well as to answer the questions of the population, a general meeting of the population will be organised in the middle of February, to which both apartment owners and tenants will be invited. A precise meeting time will be announced at the beginning of February.
