Mechanisms for addressing financial difficulties and their benefits
Lecture of representatives of the insolvency control service on mechanisms for resolving financial difficulties available in Latvia (legal protection proceedings, out-of-court legal protection proceedings, extrajudicial debt restructuring) and their benefits.
Several mechanisms exist in Latvia, addressing financial difficulties and restoring solvency – the legal protection process provided for in the insolvency law, the extrajudicial legal protection process, is also possible to settle debts outside the court by mutual agreement. Unfortunately, from 2008 to 2018, the statistics show that the legal protection process, out-of-court legal protection proceedings is used little and because the problems are started late, there are many failed processes that went into insolvency. It is therefore identified that one of the problems in which the legal protection process and the extrajudicial redress process are not used to a sufficient extent is the lack of information and good examples of processes. In order to address this situation, it is necessary to carry out a broad public education work on processes, its opportunities, benefits and good examples.
In the context of the lecture, the mechanisms for resolving financial difficulties will be addressed both by the entrepreneur in financial difficulties and by: from entrepreneur as vendor. The participants will find out what are the main reasons for financial difficulties when and how it is possible to address the main methods of debt and business restructuring, what are the reasons to be addressed, why creditors do not reconcile their debt restructuring plan, etc.
