Compensation for losses related to damage caused by non-huntable and migratory species

With the spring of spring, migratory birds return to Latvia. If most of the people of Latvia are pleased with them, then part of the peasants look at this time with concern, because after the long road drunken, swans and geese recover their forces, reluctant to sleep in the grain fields, thus causing losses to their owners.

In Latvia, there is an opportunity to receive compensation for this type of damage. This is regulated by Cabinet Regulation No. 353 of 7 June 2016, Procedures by which Land Owners or Users shall determine the amount of losses related to significant damage caused by specially protected non-huntable species and migratory species, and the minimum necessary protection measures for the prevention of damage ”.

It should be noted that compensation can be obtained not only for the damage caused by non-peditious migratory birds in crop farming, which is essential now in spring. In accordance with Paragraph 3 of these Regulations, losses shall be determined if:

  1. damage to the crop, aquaculture, livestock or beekeeping sector;
  2. the amount of damage caused exceeds the amount of the minimum monthly salary determined in one State (in euros);
  3. the area of damage in the crop production unit is not less than 0,05 hectares;
  4. damage to aquaculture in fish ponds and the area of each fish pond shall not be less than 0,1 hectares;
  5. the damage to aquaculture is made by the most important species of fish birds – the heron (Ardea cinerea) or the large white heron (Egretta alba)), the wedge (Larus ridibundus) or the small body (Larus minutus), the sea raven (Pandion haliaetus), the fish eagle (Haliaeetus albicilla), and the otter (Lutra Lutra).

Refunds may be applied for:

  • in the crop sector, during the spring and autumn migration season, but not more than once during each season;
  • in the aquaculture sector, not more than once a year;
  • in the livestock or beekeeping sector, the damage suffered.

It should be noted that compensation can only be obtained if the land owner or user has carried out the protective measures referred to in these Regulations in place of damage.

In order to qualify for compensation, the application for receipt of the damage must be submitted without delay to the nature protection authority or through the online form available in the vienotajā State and Local Government Service Portal (www.latvija.lv).
