On the evaluation of the activities of the board of directors of PSIA “Maltas DzKSU”

On 1 March 2016, a request of the Corruption Prevention and Combating Bureau (hereinafter – KNAB) was received in the municipality of Rezekne, with a call for an assessment of the actions of the board of directors of the local government company with limited liability “Maltas apartment - utility holding company” (hereinafter - PSIA “Maltas DzKSU”), submitting to the holder of capital shares applications for authorisation to carry out additional works, as well as entering into service contracts, without complying with the restrictions laid down in Section 7, Paragraph 5.3 of the Law on the Prevention of Conflict of Interest in the Activities of Public Officials (hereinafter - Law) for a member of the board of directors of a public person capital company.
On March 3, 2016, the issue of “Maltas DzKSU” member OF the Board OF Governors OF PSIA “Maltas DzKSU” was discussed at the current Rēzekne District Council. In view of the commencement of the administrative infringement initiated and the procedural actions of the evaluation relating to the violation of restrictions and prohibitions imposed on a public official of a local government capital company in accordance with the Latvian Code of Administrative Violations, the matter was discussed in the closed part of the meeting of the Council.
As a result of the decision of the Rēzekne municipality, the Council acquainted with the information set out in the REQUEST of THE CPCB, according to which Anna pinka, member of THE board of DIRECTORS OF PSIA “Maltas DzKSU”, has carried out additional works (closed service contracts for the implementation of construction supervision contracts, technical advice and construction expert services, the preparation of project applications, the quality control of technical opinions and verification in ten different European Union Structural Fund projects in several locations of Latvia), assessed the explanations provided by the attending board, and THE representatives of the shareholders of the capital shares, MR Šudra, acknowledged that PSIA “Maltas DzKSU” member OF the Board of Governors, in the exercise of the duties of the State officials, acknowledged that PSIA “Maltas DzKSU” was a member of the law.
The Rēzekne municipality council, voting in favour of 10 votes in favour (Aivars Buharins, Vilis Deksnis, Peteris Karaceyev, Igors Kolosov, Tatjana Kubecka, Elhusband Pizane, Guntis Rasims, Juris Runch, Monvīds Švarcs, Rita Žurzdina), 1 vote “against” (Stanera Deme, Janis Macans, Kaspars Melnis, Alexandra Ostrovska, Peteris Stanka), decided to express the disappointment of THE PSIA “Maltas DzKSU” member Of the Board of Governors, asking the PSIA “Maltas DzKSU” to convene a meeting of shareholders and withdraw the member of the board of directors IN accordance with the procedure laid down in laws and regulations in accordance with the procedure laid down in laws and regulations.
It should also be noted that, as regards the granting of a permit to join a position in one of the projects OF THE PSIA “Maltas DzKSU”, MR Pawka, in breach of the restrictions laid down in Section 7, Paragraph 5.3 of the Law, the holder of the capital shares of PSIA “Maltas DzKSU”, THE head of the administration of THE parish administration of Maltas, Vitalijs ants, is a disciplinary punishment on 19 February 2016 - a reprimand.
